PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY
The parties to this agreement are Baileys Horse Transport (The CARRIER); The person or entity named as the customer on the consignment note (The CUSTOMER)
Definitions and Interpretation
The expression 'The EQUINE' means the horse, pony, gelding, mare or stallion specified on the consignment note.
The expressions 'The COLLECTION ADDRESS' and 'The DELIVERY ADDRESS' mean respectively the addresses so specified on the consignment note or if notified in reasonable time by the CUSTOMER to another location as stipulated.
It is hereby declared that any sub-contractor of the CARRIER and the servants and agents of the CARRIER are third parties to this contract within the meaning of the Contracts (Rights of Third Parties) Act 1999 and shall be entitled to enforce the same accordingly.
The CARRIER will carry the EQUINE from the COLLECTION ADDRESS to the DELIVERY ADDRESS by one or more motor vehicles on the dates specified on the Consignment Note. The vehicle or vehicles shall be duly taxed and insured, shall be in a roadworthy condition and shall be suitably equipped for the safe and convenient carriage of the EQUINE. It is the CUSTOMER'S responsibility to ensure the vehicle is suitable specification for the EQUINE.
The EQUINE shall be carried at the CUSTOMER'S risk in all respects and (without prejudice to the above) the CARRIER shall not be liable for any of the following whether by reason of the CARRIER'S negligence or otherwise:
• Injury or damage to the EQUINE while in the custody or control of the CARRIER;
• Delay in delivery of the EQUINE;
• Failure follow any instruction or direction of the CUSTOMER.
It is the responsibility of the CUSTOMER at all times to maintain a policy of insurance in respect of injury to or death of the EQUINE for the duration of the transportation being undertaken by the CARRIER.
The CUSTOMER is liable to cover the cost of repairs to any damage caused by the EQUINE. The CUSTOMER has the opportunity to inspect the vehicle before loading and agree prior condition, as discussion will not be entered into subsequently. All other belongings at your own risk.
Please ensure the EQUINE has a passport, and if possible, give a copy to the CARRIER.
The CARRIER may carry the EQUINE by any route and may at the CARRIER'S discretion employ a mode of transport other than a motor vehicle for the whole or any part of the carriage.
The CARRIER'S obligations in relation to delivery are as follows:
• To deliver the EQUINE to the DELIVERY ADDRESS or if notified in reasonable time to another location as stipulated by the CUSTOMER.
• Where another DELIVERY ADDRESS is necessary or specified by the CUSTOMER, the CUSTOMER accepts and agrees to pay all additional costs and expenses.
• The CARRIER shall not be liable for any late deliveries due to either road or loading conditions.
The CUSTOMER warrants that each EQUINE in the consignment has been properly described and does load and travel without concern. 30 minutes loading time is allowed within standard call-out charge. Should the EQUINE take longer than 30 minutes to load, an additional charge of £5 per 15 minutes will be levied. Abandonment of journey is entirely at the CARRIER'S discretion. The CARRIER reserves the right to refuse to transport the EQUINE and a minimum fee will still be payable.
If your animal becomes unsettled during transit the CARRIER reserves the right to sedate your animal and/or call out an emergency vet to sedate your animal if deemed necessary. The CUSTOMER will be liable for all expenses incurred.
Any contract cancelled within 24 hours of departure will pay 50% of costs. Any contract cancelled within 12 hours of departure will be charged full amount of costs.
Unless otherwise agreed in writing, payment is due, in full, on or before COLLECTION/DELIVERY of the EQUINE.
If payment is not received on or before the agreed time, interest shall be paid at the rate of 5% above Bank of England base rate from the due date for payment of the invoice.
There is a non refundable £25 booking fee which is deducted from the cost of transport on the day.
The parties agree that these terms and conditions shall be interpreted and construed in accordance with the laws of England and Wales and shall be subject to the jurisdiction of the English courts.
Please note that Baileys Horse Transport always recommend that their Customers obtain insurance cover in respect of injury to or death of the Equine for the duration of the transportation.
